{¶ 1} On December 15, 1998, plaintiff Jeffrey L. Clark suffered bodily injury as a result of a motor vehicle collision caused by Melissa Darding (“Darding”). At the time of the accident, plaintiff was acting within the course and scope of his employment while operating a container truck for Smith’s Roll-Off Service. Plaintiff filed for and received workers’ compensation benefits and presented a claim for automobile insurance payments from Dar ding’s policy provider, Nationwide Insurance Company (“Nationwide”) and from his employer’s underinsured motorist policy…
