DECISION AND ORDER ON PLAINTIFF’S MOTION TO REMAND

This action was commenced in the Circuit Court of Peoria County on December 13, 1977, by the Peoria and Pekin Union Railway Company (P&PU), charging the defendant, Chicago and North Western Transportation Company (C&NW), with breach of contract. It was subsequently removed to this court upon the defendant’s petition, under the provisions of the removal statute. 28 U.S.C. § 1441. The case is now pending on the P&PU’s motion to remand the case back to the state court from which it was removed, pursuant to 28 U.S.C.…
