PIERCE, Senior Circuit Judge:

These appeals and cross-appeals represent another in a series of disputes involving the Shoreham Nuclear Power Station (“Shoreham”).1 Numerous issues are presented for review.

Although relying on different reasons, we affirm the district court’s grant of judgment notwithstanding the verdict in favor of the Long Island Lighting Company (“LILCO”) following a two-month trial in which the County of Suffolk (“Suffolk”) sued LILCO in the United States District Court for the Eastern District of New York, Weinstein, Judge.
