OPINION AND ORDER

BESOSA, District Judge.

This litigation arises out of Miguel A. Caceres-Cruz’s (“Caceres”) murder by former Puerto Rico Police Department (“PRPD”) officer Javier Pagan-Cruz (“Pagan”). Pagan was convicted by the Puerto Rico Court of First Instance, Humacao Division, of First Degree Murder, P.R. Laws Ann. Tit. 33, § 4734, for shooting and killing Caceres while attempting to arrest him.
