OPINION AND ORDER
BATTIN, Chief Judge.
Presently pending before the Court are cross-motions for summary judgment. For reasons stated below, plaintiff’s motion is denied and defendants’ motion is granted.
FACTS AND CONTENTIONS
On December 30, 1985, plaintiff filed an amended complaint for declaratory judgment. The Court has jurisdiction pursuant to 28 U.S.C. § 1332.
