This suit was instituted by Mrs. Pearl C. Dindsay and her husband, W. T. Lindsay, as plaintiffs, in the district court of Dallas county, Tex., against the' defendants, John W. Woods and wife, Mrs. John W. Woods.

On October 8,1928, with leave of the court, Mrs. Pearl C. Lindsay filed a first amended original petition, in which she alleged that she was married to W. T. Lindsay in October, 1927, and had never been, divorced from him; that her husband, about May 1, 1928, permanently abandoned and deserted her and moved to the state of Mississippi, where he has since continued to reside; that the…
