This is an appeal from a judgment of the Superior Court denying an application for post-conviction relief.
On June 30, 1970, Nicholas A. Palmigiano was convicted in the Superior Court of murder and robbery. It is uncontro-verted that the members of the jury which reached that verdict were not sequestered during the trial. Palmigiano appealed his conviction to this court. We affirmed. State v. Palmigiano, 112 R.I. 348, 309 A.2d 855 (1973).
Palmigiano then filed a petition for a writ of habeas corpus and a motion for a new trial in the Superior Court, alleging that during the trial the jurors had…
