This is an action in tort for deceit arising out of a false written financial statement made by the defendants to the plaintiff in connection with their application for a renewal of a loan.

*47The defendants have a finding and the report before us states that the Plaintiff claims “. . . to be aggrieved by the refusals [of the court] to rule as requested and the finding for defendants. . .”
