Two actions have been consolidated, tried, and submitted as one. In the first action the commissioner of banks of the state of Minnesota, in charge of the Browns Valley State Bank, Browns Valley, Minn., sought by claim and delivery to gain possession of certain personal property of the defendant Nielsen for the purpose' of foreclosing a chattel mortgage held by the Browns Valley Bank.
