Appeal by the defendant, Isadore Goodheim, from a judgment of the Court of General Sessions of the Peace in and for the Comity of New York, Part III, rendered against him on the 24th day of April, 1917, convicting him of the crime of perjury.

Page, J.:
The defendant was indicted and convicted of the crime of perjury in that he had testified falsely before a .grand jury. *149It is not necessary to review the evidence, nor state the facts, for in our opinion the judgment cannot be sustained because of the failure of the People to prove certain facts that were essential elements of the crime charged.
