This action was brought to recover damages for the alleged negligent killing of the plaintiff’s intestate, W. Plummer Hicks, by the defendant traveling in an automobile upon, a public highway. There was a demurrer to the evidence by the defendant, which the trial court sustained and gave judgment for the defendant. Before the end of the term the court overruled a motion by the plaintiff for a new trial on the ground of after-discovered evidence, to which rulings the plaintiff duly excepted, and the rulings of the trial court complained of are…
