In an action, inter alia, for partition of real property, the defendants appeal from an order of the Supreme Court, Suffolk County (Gowan, J.), dated August 17, 1988, which directed the sale of the property. By decision and order dated December 19, 1988, the matter was remitted to the Supreme Court, Suffolk County, for a determination as to *629whether counsel for the parties entered into an agreement to forego partition and sell the property which is the subject of this action through a broker, and the appeal was held in abeyance in the interim (see, Wolfe v Wolfe, 145 AD2d 556).
