AMENDED MEMORANDUM

On January 9, 2003, while swimming at the Cinnamon Bay beach on St. John, Richard Wyatt (“Wyatt”) was struck by a breaking wave. As a result, Wyatt was driven into the sand and suffered a broken neck, which left him a quadriplegic. At the time of his injury, Wyatt was vacationing at the Cinnamon Bay campground, which is located within the confines of the Virgin Islands National Park, under the control of the National Park Service (“the Park”).
