CIRE, Justice.

This is an appeal from a summary judgment in favor of the third party defendants in a case in which an employee is seeking damages for injuries sustained in the course and scope of his employment. The employee, Wayne Kerry Guice, was injured while he was riding in a basket being lifted by a crane. The crane was operated by appellee Paulo Valadez, and both Valadez and Guice were employees of appellee Cardinal Construction Company.
