On April 3, 1963, by order of this court, we allowed plaintiff’s petition for leave to appeal within one year from the denial of his post-trial motion.

The plaintiff, Eobert Wesley Dawson, a pedestrian, was struck by an automobile driven by the defendant, Thomas K. Hoffmann, a minor, on November 28, 1960, in the City of Barrington, Lake County, Illinois. At the time of the occurrence, the defendant was a minor seventeen years of age. The plaintiff filed a complaint for damages for personal injuries against the defendant. The case was tried before a jury in the Circuit Court of Lake County…
