Appellant Eric Dawson appeals the order of the trial court dismissing his appeal of the decision of appellee Richmond Heights Local School District Board of Education (“the Board”) upholding his five-day suspension from high school.
On January 12, 1995 appellant was observed standing outside the high school lobby smoking a cigarette. The teacher who observed appellant smoking in violation of the Student Code of Conduct referred the matter to the school’s administration.
