This is an action for damages filed in the district court for Dundy County, Nebraska, by Eldon Cawthra, plaintiff and appellant, against Vilas Shackelford and Plains Oil Company, a copartnership, defendants and' appellants, growing out of a collision between an automobile operated by Vilas Shackelford and a tractor owned and operated by Eldon Cawthra. The action is based on a charge of negligence on the part of defendant, Vilas Shackelford, while engaged in the service of the copartnership of the defendant Plains Oil Company of which he was a partner.
