William F. Beckman, (herein called defendant in error,) as a judgment creditor of Brechter H. Alberts, filed a bill in equity in the circuit court of Kankakee county against Brechter and plaintiff in error, Dave Alberts, who are brothers, asking that the interests of the parties in the proceeds of the sale of certain personal property of Brechter might be determined and that he and plaintiff in error might be decreed to account to defendant in error for the proceeds of the sale of the property.
