DECISION AND ORDER

MARRERO, District Judge.

Plaintiffs Bridgeport Music, Inc. (“Bridgeport”) and Southfield Music, Inc. (“Southfield”) (collectively, “Plaintiffs”) filed a complaint (the “Complaint”) against defendants UMG Recordings, Inc. 1 (“UMG”), Napster, LLC (“Napster”), Apple Computer, Inc. (“Apple”), and Yahoo!, Inc. (“Yahoo”) (collectively, “Defendants”) seeking declaratory judgment, permanent injunctive relief and damages for copyright infringement. Defendants filed an answer denying most of Plaintiffs’ allegations and asserting a counterclaim against Bridgeport for breach of contract.…
