OPINION OF THE COURT
Levine, J.
Defendant pleaded guilty to counts of attempted murder in the second degree, attempted robbery in the first degree and criminal possession of a weapon in the second degree. The charges arose out of a failed holdup by him and two accomplices at the home of the victim, whom defendant shot three times in a struggle during the incident. County Court convicted defendant upon his guilty plea and the Appellate Division affirmed the judgment of conviction and sentence (232 AD2d 426). A Judge of this Court granted defendant leave to appeal, and we now affirm.
