The defendant, a small village, has appealed from a verdict and judgment of $1,500, recovered by the plaintiff in an action for injury to her health. She charges that ditches or drains within the village, and made by the village, were allowed to collect filth from sinks, water-closets, etc., and discharge the same into other open drains, thereby causing the refuse to be conveyed to a ditch in front of her home, to which there was no adequate outlet, where it remained, giving off foul smells and malaria, causing her illness and discomfort.
