PINE, District Judge.
This case is before me on a motion by defendant to dismiss the complaint for failure to state a cause of action, and on a motion by plaintiff for summary judgment. The facts are undisputed, and are as follows:
In 1944 plaintiff filed an action against the United States, in the United States District Court for the District of Delaware. Its claim was based on a contract of insurance issued to plaintiff by the Administrator, War Shipping Administration, in respect of the Steamship Virginia.
