Mrs. Mittie Todd brought suit against H. D. Pollard as receiver of the Central of Georgia Railway Company, to recover damages for the death of her husband, Strozier T. Todd, caused by the operation of one of the defendant’s trains, as -her husband was walking along the railroad-tracks. The plaintiff alleged that her husband came upon the railroad-tracks from a footpath which led from his home to the railroad right of way; that people customarily walked along the railroad at that point in going from the crossing of a public highway by the railroad to a flag stop, with the consent and approval…
