The Chancellor :

With regard to the contract of the 8th of July, 1844, as set out in the receipt of that date, I do not deem it necessary to express any opinion, as it is manifest, that that contract, whatever its character may have been — whether obtained by false and fraudulent representations or not — has been merged in the subsequent agreement of July, 1845 ; which subsequent agreement alone, this bill seeks to enforce.
