Introduction

This is an adversary proceeding brought by First Federal Savings & Loan of Lincoln (“Lincoln”) against Bevill, Bresler & Schul-man, Inc. (“BBS, Inc.” or “the Debtor”); Richard W. Hill, as Trustee of BBS, Inc.; and Security Pacific Clearing & Services Corporation (“SePae”) in the liquidation proceeding of BBS, Inc. pursuant to the Securities Investor Protection Act (“SIPA”), 15 U.S.C. § 78aaa, et seq. Lincoln and the Trustee for BBS, Inc. cross-move for partial summary judgment.
