The respondents in this petition for a writ of mandamus are the mayor and superintendent of streets of the city of Fall River. The petitioner was registered in the labor service according to law and the rules of the civil service department of the Commonwealth, and was employed by the city on July 30, 1923, as “chauffeur and auto mechanic.” John Delaney was registered and employed as a “laborer” in 1906.
