Defendants-appellants appeal the judgment of the Hamilton County Court of Common Pleas in plaintiffs-appellees’ taxpayer lawsuit filed pursuant to R.C. 733.59. 1 Appellants include the city of Cincinnati (“city”); Cincinnati Civil Service Commission (“commission”); Cincinnati Board of Health (“board”); and Lowery Clark (collectively, “appellants”). Appellees include Earl D. Simons and Logan M. Daugherty (collectively, “appellees”). For the reasons that follow, we affirm the trial court’s judgment in part, reverse in part, and remand for further proceedings. 2
