Before the Court are cross motions for summary judgment. The case in which these motions arise involves a money order in the amount of $24,190.00 issued by Defendant Duncan Savings and Loan for the benefit of McAffrey Funeral Home payable to the order of Plaintiff, First National Bank of Nocona. Prior to Plaintiffs presentment of the money order to the Federal Home Loan Bank of Topeka, Kansas, the drawee bank, Defendant Duncan Savings and Loan, at the request of A1 McAffrey, issued a stop payment order on the money order, which was honored by the Federal…
