FACTS AND PROCEDURAL HISTORY

¶ 1. Sarah Lynn Hudspeth was driving on Sport Watkins Road in Kemper County at approximately 10:20 p.m. on December 27, 2006, when her car collided with a vehicle being driven by Victoria Edwards. Edwards was deceased by the time the emergency responders arrived. Hud-speth’s blood-alcohol content after the accident was .24 percent, well above the legal limit of .08 percent. Miss.Code Ann. § 63-11-30(1) (Supp.2008).
