The defendant was charged with breaking and entering a building with the intent to commit larceny. MCLA 750.110; MSA 28.305. The defendant’s ^arrest arose when the automobile that he was driving was stopped by Trooper Rupert L. Boynton of the Michigan State Police. At the time of the stop, Trooper Boynton observed some evidence in the defendant’s car and certain statements were made to Trooper Boynton by the defendant.
