BLATCHFORD, District Judge.
The petitioner, Hoses De Puy, represents that he is restrained of his liberty by John Fitch, warden of the penitentiary at Blackwell's Island, within the southern district of New York; that the said John Fitch, warden, as aforesaid, claims to restrain the petitioner of his liberty, and to detain him at the penitentiary aforesaid, on the following grounds, namely, that, at the January term, 18G9, of the circuit court of the United States for the southern district of New York, one Jacob De Puy and the petitioner were convicted of having rescued spirits from the…
