OPINION
WARD, District Judge.
James M. Morrissey (“Morrissey”), a member of the National Maritime Union of America (“the Union”), brought this action in June, 1972, alleging violations of his rights under 29 U.S.C. § 411(a)(2) and (5) (hereinafter referred to as the Landrum-Griffin Act), and malicious prosecution, on the part of certain Union officers and employees and the Union itself.
