This matter comes before the Court on remand from the Ninth Circuit to make a factual determination of Plaintiffs’ damages in Docket Nos. 3:05-cv-01809 (“Rubicon I”), 3:09-cv-00818 (“Rubicon II"), and 3:09-cv-01397 (“Rubicon III”).
