Suit by plaintiff, Zack R. Hall, to recover damages for the killing of his jack through the alleged negligence and carelessness of the defendant, its agents and servants, in running upon and against the same with ■an engine and train. Suit by appellee for damages for the killing of his jack by negligently running defendant's passenger locomotive over him. Trial by jury. Verdict and judgment for plaintiff for $800, with 6 per cent interest from the 16th day of December, 1893, the date of the injury.

Defendant has appealed.
