Several motions are pending before the Court in this commercial dispute ease. Defendant Direct Response Publications, Inc. (“Direct” or “Defendant”) has moved to dismiss the claims filed against it [Doc. #22] (“Motion to Dismiss”). 1 Plaintiff The Decorative Center of Houston, L.P.
