This was a suit brought by the appellant as administrator de bonis non, with the will annexed, of Christian Beck, deceased, against Martha J. Beck, Mary Josephine Beck, and Josephine White, formerly Beck, his sole legatees, to secure a judicial construction of the last will of said Christian Beck, deceased, by the Circuit Court upon certain disputed points. At the request of the appellant, the Circuit Court made a special funding of the *615facts upon which it stated certain conclusions of law, to which appellant excepted.
