Plaintiff filed an action seeking to be reimbursed on the theory of common law indemnity for the expense *132of defending an action brought against it by an injured workman of defendant. Defendant interposed a demurrer which was sustained and plaintiff appealed from the resulting judgment.

The complaint stated that plaintiff entered into a contract with defendant to design and construct a digester system used in the manufacture of paper pulp in defendant’s mill. After completion of the work and its acceptance, one Weber, an employe of defendant, was injured as the result of an explosion of a flash…
