ORDER
HURLEY, Senior District Judge:
On November 18, 2010, Abraham Mir-man (“plaintiff’ or “Mirman”) commenced this diversity action against Robert Feiner (“defendant” or “Feiner”) alleging breach of contract, breach of fiduciary duty, and promissory estoppel. In response, Feiner moved to dismiss, pursuant to Fed. R.Civ.P. 12(b)(2), 12(b)(3), and 12(b)(6). By Memorandum & Order dated September 28, 2012, the Court granted defendant’s motion under Rule 12(b)(2), and dismissed the Complaint without prejudice for lack of personal jurisdiction. Mirman v.
