The City of Wilkes-Barre (City) appeals an order of the Court of Common Pleas of Luzerne County (trial court), which denied the City's request to vacate a grievance arbitration award in favor of Fire Fighters Local Union No. 104 (Union). The arbitrator concluded that the City's effort to assign a case manager to monitor the Heart and Lung Act 1 benefits paid to a firefighter was not authorized by the parties' collective bargaining agreement (CBA) and, thus, sustained the grievance.
