In. view of what we- consider the controlling questions in this case, it is not essential to deal specially with the numerous assignments of error contained in the record, and we shall therefore confine our remarks to the points upon which we have found it necessary to rule.

1. The Fidelity and Casualty Company (to which we shall hereinafter refer as the “Company”) undertook by its bond-to make good to the Gate City National Bank of Atlanta (which will hereinafter be called the “Bank,”) such pecuniary loss, not exceeding $10,000.00, as it might sustain by reason of the fraud…
