PANCOAST, J.:

This was an action brought by the defendant in error against the plaintiff in error in the district court of Kay county, to recover the sum of five thousand dollars for personal injuries alleged to have been sustained through an assault and battery committed by the plaintiff in error upon the defendant in error, on the 14th day of April, 1902. The injuries alleged to be the result of the assault and battery are: inflammation of the uterus, fallopian tubes, bladder and its appendages, fox which .injuries plaintiff alleges :
