This matter is before the Court upon the motion of H. Christopher Clark, Chapter 7 Trustee (Trustee), for summary judgment to deny the plaintiff’s claims for declaratory relief affirming the validity of a post-confirmation contract between the plaintiff, Michael Blumenthal (Mr. Blumenthal) and Fred T. Hiller (Debtor or Hiller); for in-junctive relief to prevent the Trustee from taking actions inconsistent with the contract; and for breach of contract based upon the Trustee’s repudiation of the contract.
