At tbe trial in the Superior Court, with a jury, it appeared that the plaintiff was employed by the defendant as a flagman, at Baker’s crossing, under a contract to receive for his services in that capacity each week the sum of eight dollars and fourteen transportation tickets, good on the defendant’s road. At the time of the accident he was riding in a car of the defendant, having finished his work, having put out the lights at the crossing, and having left the same and his flag, for the night, to go to Lakewood, his home.
