PRETTYMAN, Circuit Judge.

This is an appeal from a judgment of the United States District for the District of Columbia. Appellant brought a civil action for a declaratory judgment, and the court dismissed the complaint for failure to state a cause of action.

' The plaintiff prayed that the court declare her to be an American citizen. She was born in Italy November 2, 1921. Her father entered the United States for permanent residence and was duly naturalized on September 10, 1929. At that time the plaintiff was eight years old and still lived in Italy.
