— Judgment entered in the Supreme Court, New York County, on December 21, 1973 convicting the defendant of two counts of burglary in the second degree and one count of assault in the second degree and sentencing him to concurrent indeterminate terms of imprisonment not to exceed six years for each of the burglary convictions and a concurrent three-year term for the assault conviction, unanimously modified, on the law, so as to reverse the convictions of the burglary counts, vacating the sentences imposed thereon and dismissing said burglary counts.
