Background

Pending before the court is the motion filed pursuant to Federal Rule of Civil Procedure 12(b)(6) by defendant United Parcel Service, Inc. (“UPS” or “defendant”) (Doc. No. 5) to dismiss with prejudice in their entirety the class action allegations and class claims asserted by Preston Eugene Branum (“Branum” or “plaintiff’). Plaintiffs complaint alleges a violation of the Americans with Disabilities Act of 1990 (“ADA”), 42 U.S.C. § 12101 et seq., against UPS for discrimination in employment on behalf of himself and all others similarly situated.…
