Two cases are submitted together, namely: Dowagiac Manufacturing Company, Appellant, v. Deere & Webber Company, Appellee, and Deere & Webber Company, Appellant, v. Dowagiac Manufacturing Company, Appellee, being a cross-appeal on the part of Deere & Webber Company. For convenience we will designate the parties as follows: Dowagiac Manufacturing Company as plaintiff-appellant, and Deere & Webber Company as defendant-appellant.
