OPINION AND JUDGMENT

MICHIE, District Judge.

Petitioner is now detained in the Virginia State Penitentiary pursuant to a judgment of the Circuit Court of Nelson County entered on July 3, 1963. At that time he was sentenced on two charges— one for the statutory rape of a thirteen year old girl and one for the attempted statutory rape of an eleven year old girl, the older girl’s sister. He received sentences of twenty and ten years respectively on the two charges, the sentences to run consecutively.
