OPINION AND JUDGMENT
DALTON, Chief Judge.
This ease comes before the court on a petition for a writ of habeas corpus under 28 U.S.C. § 2241(c) (3). The petition was filed in forma pau/peris on May 5, 1970, in the United States District *876Court for the Eastern District of Virginia at Richmond which ordered the case transferred to this court.
On August 13, 1962, petitioner was convicted after a not guilty plea in the Circuit Court of Culpeper County on two counts of escape and in the Circuit Court of Fauquier County for auto larceny. Prior to the attempted robbery conviction, petitioner had been…
