Judgment, Supreme Court, New York County (Jerome Hornblass, J., at hearing, jury trial and sentence), rendered July 2, 1987, convicting defendant, after a jury trial, of robbery in the first degree and sentencing him to an indeterminate term of imprisonment of 7 to 14 years, unanimously affirmed.

The day after defendant robbed his victim on a subway staircase, she identified him at a lineup. Defendant now argues that the proceeding was unduly suggestive because he was heavier and taller than the others. We find no unnecessary suggestiveness that was conducive to an erroneous identification.…
